This privacy policy applies to our use of any and all Data collected by us or provided by you in relation to your use of the Website.
The policy governs the privacy of all visitors to the website and explains how we comply with the EU’s GDPR (General Data Protection Regulation) legislation and the DPA (Date Protection Act).

This website and the collection of data, to the best of our knowledge, complies with the DPA (Data Protection Act 1998) and the GDPR (General Data Protection Regulation), effective from May 2018.
CONTACTING US
This website, www.clarkiephotography.com collects private user data using the client contact form located here; https://www.clarkiephotography.com/contact/
The personal data collected on completion of this form are as follows:
- Names
- Phone number
- Email Address
- Wedding Details (location and date)
- Source of where clients found out about us (e.g friend, wedding planner or other website)
The data from a submitted form is immediately emailed to our business email rich@clarkiephotography.com and a copy of the data is also captured in our Business Management System, Tave https://tave.com. The form data is also held in our WordPress website backend which is hosted with Siteground https://www.siteground.com

We use Tave to manage all client information once formal contact is made via the website contact form. We use it to communicate with clients, issue contracts, provide quotes, issue invoices and manage the entire sales process from contact to job completion. The data is never shared with any third parties and nobody other than myself as the owner, currently has access to the Tave account, which is password protected.
Should you wish to have your records removed from Tave and any emails containing your personal data to be deleted, please contact me at rich@clarkiephotography.com.
By completing the contact form linked above, you agree to Clarkie Photography contacting you about wedding, commercial or family photography services. We never use your personal details for marketing purposes, nor will they be passed onto any third parties. With your details, we may contact you directly via e-mail, telephone call, text message or social media.
EMAIL MARKETING
Clarkie Photography does not engage in any email marketing practices and will not share your details with any third parties who do.
GOOGLE ANLYTICS
We do use Google Analytics on this website. This is a third party service which provides information about how visitors use our website. We may use the information from this service to understand how the site is used by visitors. This is essential for us to understand how our website runs. Please be assured that Google is fully GDPR compliant.
CLIENT GALLERIES (PROOFING & PRINT SERVICES)
Clarkie Photography will create a private, password protected online proofing gallery for every client that signs a contract for photography services. Completed photographs will be uploaded to this gallery and sent to the clients as a final deliverable. The galleries are hosted externally by https://pic-time.com
When you first access your private gallery, you will be asked to enter your names and provide an email address and password. This data will be stored on the Pic-time system and I will have access to it. The system will use this information to email you when photographs are ready to be viewed and will be used if and when you order prints within the system. We may chose to send clients offers for discounted prints or holiday offers/vouchers but the system allows you to opt out at anytime.

CLIENT DATA
Throughout the entire process of working with us, from initial contact to completion of the contracted services, the following is the data we may collect:
- Names
- Email Address
- Home Address
- Phone Number
- Wedding details (venue address and timelines)
- Consultation notes (notes about your wedding and specific requirements made during a client call)
Client contracts, for services created, are stored and issued from Tave only, and will contain your names, addresses, email, phone number and shoot dates/location. We don’t print soft copies of the contracts, they are always issued and signed electronically. They will be held on Tave servers and accessible by me via my password protected Tave account.
CLIENTS AND WEDDING GUESTS CAPTURED IN PHOTOS
Under GDPR legislation, a photograph may in some instances constitute a form of personal data where they can be processed to allow “the unique identification or authentication of a natural person”. Clarkie Photography will never photograph an individual as a means of unique identification or authentication unless consensually contracted to do so. Guests at weddings appear in photos taken by Clarkie Photography as a part of the visual recording of the event in photos. Guests captured in portraits or in group photos do so as part of the event and their rights are protected by Clarkie Photography as detailed in this privacy policy.
In terms of explicit GDPR compliance, wedding clients and guests are photographed within the parameters of GDPR legislation on the basis of ‘legitimate interests’. The taking of photographs of wedding guests when viewed as a form of processing personal data is necessary for the legitimate interests of Clarkie Photography as a photography business unless there is a good reason to protect a given individual’s personal data which overrides those legitimate interests.
Operating within the parameters of legitimate interests as laid out in GDPR legislation, the disproportionate effort involved in providing privacy policy information to all wedding guests at the event and the degree to which it would distract us from performing our job renders it infeasible to do. Wedding clients are therefore requested in their contract to direct their guests to read this privacy policy in advance of the event and to advise them to contact us in advance with any concerns around the processing of their personal data, namely being photographed.
WITHDRAWL OF CONSENT
Anyone photographed by Clarkie Photography, whether a client or wedding guest, and whether past or current may withdraw consent for a photograph in which they appear to be displayed. The process for this is to email Clarkie Photography at rich@clarkiephotography.com specifying the photo in question. Pursuant to the request, Clarkie Photography will then remove the photo from online and printed display wheresoever it appears.
SOCIAL MEDIA POLICY & USAGE
We adopt a safe and responsible Social Media Policy. While we may have official profiles on social media platforms, users are advised to verify the authenticity of such profiles before engaging with, or sharing information with such profiles. We will never ask for personal details on social media platforms. Users are advised to conduct themselves appropriately when engaging with us on social media.
DISPLAY OF IMAGES
We may display any photographs to promote Clarkie Photography on the Clarkie Photography website and blog, on social media, on wedding blogs, on wedding photography related websites, in exhibitions, in online and print advertising, brochures, magazine articles and other such material, providing that the images used are used lawfully and without damage to Clarkie Photography client(s). The rights of the people captured in these photographs are protected by Clarkie Photography as detailed in this privacy policy.
